Acceptance of Terms
By creating an account or using HelpTrax you agree to these Terms of Service. If you do not agree, do not use HelpTrax.
What HelpTrax Is
HelpTrax is a software tool that helps small businesses manage customer communication, capture leads, and handle appointment bookings through an AI-powered chat assistant. HelpTrax is a technology platform only. We are not a party to any transaction, agreement, or relationship between you and your customers.
Your Responsibilities
As a business owner using HelpTrax you are responsible for:
- The accuracy of the information you provide in your business profile and FAQs
- All interactions between your chatbot and your customers
- Honoring any appointments booked through HelpTrax
- Complying with all applicable laws in your industry and location
- Keeping your account credentials secure
HelpTrax Is Not Responsible for Business Transactions
HelpTrax provides tools to facilitate communication and bookings between you and your customers. We are not responsible for:
- Any dispute between you and your customers
- Missed, cancelled, or unfulfilled appointments
- Payment disputes between you and your customers
- Refunds or chargebacks between you and your customers
- The quality of your services or products
- Any financial loss arising from your use of HelpTrax
Any issues between you and your customers are solely between you and your customers. HelpTrax has no obligation to intervene in any such dispute.
No Liability for Physical or Property Damage
HelpTrax is a digital communication tool only. We are not responsible for:
- Any physical injury or harm to a customer, client, or any third party arising from a service or appointment booked through HelpTrax
- Any damage to property belonging to a customer, client, or any third party
- Any physical injury or harm to a business owner or their staff
- Any damage to a business owner's property
Any incident involving physical injury or property damage is solely the responsibility of the parties involved. HelpTrax has no involvement in and accepts no liability for any such incident.
Notice to Customers and Clients
If you are a customer or client who booked an appointment or interacted with a business through HelpTrax, please be aware that HelpTrax is a technology platform used by the business and we are not the service provider.
- Any dispute, complaint, or issue you have regarding a service, appointment, payment, refund, or experience must be taken up directly with the business owner
- HelpTrax is not responsible for the actions, services, or conduct of any business using our platform
- HelpTrax cannot intervene in or resolve disputes between you and a business owner
Zero Tolerance for Fraud and Fake Accounts
HelpTrax has zero tolerance for fraud, scams, or deceptive activity. The following will result in immediate account termination without refund or prior notice:
- Creating a fake or fraudulent business profile
- Misrepresenting your identity or business
- Using HelpTrax to scam, deceive, or defraud customers
- Any attempt to manipulate or abuse the platform
We reserve the right to permanently ban any account found engaging in fraudulent activity and to report such activity to the appropriate authorities where necessary.
Payments and Subscriptions
HelpTrax subscription fees are billed monthly through our payment processor. All prices are in Canadian dollars. Subscriptions auto-renew unless cancelled before the renewal date. We do not offer refunds for partial months. Your 14-day free trial begins when you activate it and ends automatically with no charge unless you add a payment method. Accounts terminated for violating these terms are not eligible for any refund.
Acceptable Use
You may not use HelpTrax to:
- Violate any applicable law or regulation
- Deceive or mislead your customers
- Send spam or unsolicited messages
- Collect customer information without their knowledge
- Engage in any fraudulent or scam activity
We reserve the right to suspend or terminate accounts that violate these terms without notice or refund.
Service Availability
We aim to keep HelpTrax available at all times but we do not guarantee uninterrupted service. We are not liable for any loss or damage caused by downtime, errors, or interruptions to the service.
Limitation of Liability
To the fullest extent permitted by law, HelpTrax shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to lost revenue, lost customers, business interruption, physical injury, or property damage. Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months prior to the claim.
Termination
You may cancel your account at any time from your dashboard. We reserve the right to suspend or terminate your account if you violate these terms. Accounts terminated for policy violations are not eligible for a refund. Upon termination your data will be deleted within 30 days.
Changes to These Terms
We may update these terms from time to time. We will notify you of significant changes by email. Continued use of HelpTrax after changes means you accept the updated terms.
